Terms of Service

These terms govern early-access use of Publication Intelligence by individual and business customers.

1. Agreement and provider

These Terms of Service form a contract between you and Publication Intelligence LLC, a Minnesota limited liability company ("Publication Intelligence," "we," or "us"), for Publication Intelligence and related services. If you use Publication Intelligence for an organization, you represent that you can bind it; "you" then includes that organization. If you use Publication Intelligence personally, you contract in your individual capacity.

By creating or activating an account, you agree to the version identified above and acknowledge the Privacy Notice. If you do not agree, do not create, activate, or use an account.

2. Eligibility and accounts

You must be at least 18 years old and the age of majority where you live, and legally able to enter this contract. Account information must be accurate. You are responsible for safeguarding account access, activity under your account, and promptly notifying us of suspected unauthorized access.

3. Your manuscripts and permission to process them

You retain ownership of manuscripts, project materials, instructions, edits, and other content you submit ("Customer Content"). You represent that you own Customer Content or have all permissions needed to upload it and direct us to process it.

You grant us and our service providers a limited, nonexclusive, worldwide license to host, copy, transmit, analyze, transform, display, and otherwise process Customer Content to provide, secure, support, and operate the requested service, comply with law, and enforce applicable agreements. This license ends when the content is deleted from active systems, subject to recovery systems, provider retention, and retained records described in the Privacy Notice.

4. Output, ownership, and human review

As between you and us, you own the project output created for you, subject to any rights in third-party materials and the service technology. We retain all rights in Publication Intelligence, its software, models, workflows, documentation, and general know-how; no rights are granted except those expressly stated here.

Generated indexes and related suggestions are drafts produced with automated systems and may contain omissions, errors, unsupported locators, or unsuitable editorial choices. You are responsible for assigning a person with appropriate knowledge of the manuscript, indexing requirements, house style, and publication context to review the result before publication. We do not supply or independently verify that person’s identity or qualifications.

Publication Intelligence records review actions made through an authenticated account, but those records do not prove that a professionally qualified person made the decision. Publication Intelligence does not require completed review or approval before export, and an available export is not a statement that an index is complete, approved, or ready for publication.

5. Acceptable use and sensitive data

You may not use the service illegally; infringe intellectual-property, privacy, publicity, confidentiality, or other rights; upload material without authorization; introduce malware; probe or disrupt security; evade limits; reverse engineer except where law forbids restriction; or use the service to build a competing model or service.

Do not upload classified information, payment-card data, authentication secrets, government identification numbers, protected health information, regulated financial records, export-controlled technical data, data subject to heightened child-protection duties, or other high-risk regulated data unless we expressly agree in writing to support that data. Publication Intelligence is not designed for decisions that determine a person’s eligibility for healthcare, credit, employment, housing, insurance, education, legal services, or other high-impact regulated opportunities.

6. AI and cloud service providers

Publication Intelligence uses cloud infrastructure and commercial AI APIs operated by providers that may include OpenAI, Anthropic, and Google. Provider handling can vary by endpoint, feature, service tier, account setting, agreement, safety event, and law. Their systems remain outside our direct control, and the Privacy Notice and Privacy & Security page describe the current application paths and important limits.

7. Fees, checkout cancellation, and refunds

Publication Intelligence remains in early access, and public registration is disabled. Billing is enabled for eligible existing accounts; purchases require a U.S. billing address and are available only when we enable them for an eligible account. Prices, included services, payment timing, and any usage limits are shown when you order. When a purchase is available, Publication Intelligence opens Stripe-hosted Checkout and requests Stripe Managed Payments. Stripe and Link receive payment-method and billing details directly; Publication Intelligence does not store full card numbers.

For a transaction identified at checkout and on the receipt as sold through Link, Link is the merchant of record. Stripe handles payment collection, transaction receipts and invoices, transaction-level payment and refund support, fraud screening, disputes, and indirect-tax compliance where Managed Payments provides tax coverage; Stripe may issue refunds in circumstances described by its Managed Payments terms. Publication Intelligence remains the service provider and handles product delivery, product-level support, the Limited Quality Guarantee, product-specific information requested for a Stripe escalation, refunds we elect or are required to issue, and obligations that Managed Payments does not assume. The checkout terms and receipt identify the parties and terms for the particular transaction; a preview or disabled checkout does not prove live account configuration or tax treatment.

You may leave hosted checkout before successful payment or cancel an incomplete checkout while the application still marks it cancellable. A checkout cancellation is not a cancellation of work after successful payment. Processing starts immediately after successful payment. Once processing begins, charges are nonrefundable except where mandatory law requires otherwise or for an uncured material defect covered by the Limited Quality Guarantee. You remain responsible for accurate billing information and any taxes assigned to you in the checkout terms.

8. Limited Quality Guarantee

Report a claimed material defect to support@publicationintelligence.com within 30 days and reasonably cooperate with diagnosis. For an eligible paid project, Publication Intelligence may correct, rerun, or replace the affected output at no additional charge. If we reasonably determine in good faith that the output cannot be brought into material conformity within 30 days after receiving sufficient defect information, we will refund the affected service charge, including preparation when a preparation defect invalidated downstream indexes.

The versioned purchase terms presented at checkout define the guarantee’s defect thresholds, included failures, exclusions, and assent record. Editorial preferences or reasonable differences in professional judgment alone are not defects. The guarantee is cure-first and is not an unlimited satisfaction promise; mandatory legal remedies remain available.

For payment or refund transaction support on a Managed Payments purchase, you may also use the Link support path shown on the receipt. For some current processing failures, an authenticated project may offer an in-product support request. Do not send manuscript text or other sensitive publication content through ordinary email or free-form support notes. We do not publish a guaranteed response time.

9. Beta and service changes

Publication Intelligence is an early-access product and new public registration is disabled. Access is limited to accounts we approve. Beta or preview features may be incomplete, change without notice, or be withdrawn. We may modify, suspend, or discontinue features, impose reasonable limits, or perform maintenance. We do not promise uninterrupted availability or that any feature will remain available.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT FOR THE EXPRESS LIMITED QUALITY GUARANTEE, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RESULTS. WE DO NOT WARRANT THAT OUTPUT IS COMPLETE, ERROR-FREE, OR READY FOR PUBLICATION WITHOUT HUMAN REVIEW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, OR DATA, ARISING FROM THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

EACH PARTY’S TOTAL LIABILITY ARISING FROM AN AFFECTED PROJECT OR THESE TERMS WILL NOT EXCEED THE GREATER OF US $100 OR THE FEES YOU PAID US FOR THE AFFECTED PROJECT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These exclusions and limits do not apply where prohibited by mandatory law, or to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

12. Suspension, termination, and deletion

You may stop using the service and request account deletion. We may suspend or terminate access for material breach, nonpayment, security or legal risk, or discontinuation of the service. Where practical, we will give notice and an opportunity to cure.

After termination, your right to use the service ends. A project or account deletion request starts the applicable deletion process and removes access, but cleanup may be retried and recovery systems, providers, and retained security, support, agreement, transaction, tax, accounting, dispute, and legal records follow separate schedules and exceptions described in the Privacy Notice. Deletion is not immediate erasure of every copy everywhere. Provisions that by their nature should survive do survive, including ownership, payment obligations, disclaimers, liability limits, and governing law.

13. Governing law and disputes

Minnesota law governs these terms without regard to conflict-of-law rules. State and federal courts located in Minnesota have exclusive jurisdiction, and each party consents to venue there. Mandatory consumer protections and small-claims rights that cannot be waived remain available.

14. Changes and general terms

We may update these terms. We will post the new version and effective date and, for material changes, provide reasonable notice before they take effect. If law or the nature of a material change requires renewed consent, we will request it. Continued use after an effective change constitutes acceptance where permitted by law.

These terms, incorporated order details, the applicable Limited Quality Guarantee, and the Privacy Notice are the complete agreement about the service. If an order expressly conflicts with these terms, the order controls for that purchase. You may not assign these terms without our consent; we may assign them in connection with a merger, reorganization, or sale. Failure to enforce a provision is not a waiver. Invalid provisions will be limited to the minimum necessary, and the rest remain effective.
